Terms And Conditions
These terms set out how Plymouth Digital Services provides website design, domain registration, hosting, and related support. By ordering, renewing, or using any service, the customer agrees to these terms.
Nothing in these terms removes or limits any legal rights that apply under UK law. If a specific term cannot apply, the rest of the terms still apply.
How Services Are Provided
Plymouth Digital Services supplies managed hosting, domain services, and website design for UK customers. The agreement includes these terms plus any written scope, invoices, emails, or proposals that Plymouth Digital Services confirms for the customer’s project.
Plymouth Digital Services provides services in a practical, business-focused way. However, Plymouth Digital Services may refuse work, pause work, or limit access where content, instructions, or behaviour creates risk, breaches law, or breaches third-party rules.
Definitions
“Customer” means the person or business buying services from Plymouth Digital Services. “Services” includes hosting, domain registration, website build work, maintenance, and support.
“Website” means the files, content, and configuration hosted or managed under the customer’s plan. “Content” includes text, images, video, logos, data, downloads, and anything else supplied or approved by the customer.
Orders, Scope, And Changes
Plymouth Digital Services will confirm what is included before or during the build. The standard website build covers the agreed page set and typical small business features, unless Plymouth Digital Services agrees to additional work in writing.
If the customer asks for changes that increase the scope, Plymouth Digital Services may quote for extra work or adjust timelines. Plymouth Digital Services will aim to keep changes clear and avoid surprises.
Customer Content And Approvals
The customer is responsible for the accuracy and legality of all content supplied or approved for use on the website. That includes claims, pricing, contact details, compliance statements, and any regulated information.
The customer must confirm approvals in a timely way. If approvals or required content are delayed, the project timeline will move, and Plymouth Digital Services is not responsible for lost opportunities caused by delay.
Third Party Services And Licences
Websites may use third-party services such as plugins, fonts, maps, analytics, payment providers, or embedded media. Those services may change, limit features, or enforce their own terms, and Plymouth Digital Services cannot control those decisions.
If a third-party licence, subscription, or paid feature is required, Plymouth Digital Services will tell the customer. The customer covers third-party costs unless Plymouth Digital Services confirms otherwise in writing.
Hosting, Performance, And Security
Hosting keeps the website online and includes routine operational care such as monitoring and security controls. Plymouth Digital Services will take reasonable steps to keep services stable, secure, and maintained.
However, no hosting provider can guarantee uninterrupted service. Outages may happen due to maintenance, upstream faults, third-party failures, attacks, or events outside reasonable control. Plymouth Digital Services is not liable for downtime beyond fees paid for the affected period, except where UK law requires otherwise.
Domains, Registration, And Ownership
Domain registration depends on availability and registry rules. Plymouth Digital Services will register the domain requested by the customer when possible, and will renew it while the relevant plan stays active and paid.
If the customer chooses monthly payments, Plymouth Digital Services will hold the .com or .uk domain registration for the customer until the final monthly payment for the first year has been paid. After that first year is fully paid, Plymouth Digital Services will transfer the domain registration ownership to the customer on request, provided the account has no overdue balance and the customer supplies any required registration details.
Billing, Renewals, And Non Payment
The customer must pay fees on time, whether billed annually or monthly. Plymouth Digital Services may suspend hosting, email, or related services if payments fall overdue, because continued service creates cost and risk.
If services are suspended, Plymouth Digital Services may charge a reasonable admin fee for reinstatement. If non payment continues, Plymouth Digital Services may cancel services and remove hosted content after a reasonable period, while keeping records as required for business, legal, and audit purposes.
Support, Maintenance, And Changes After Launch
Plymouth Digital Services provides support according to the customer’s plan and any agreed service level. Response times can vary depending on workload, supplier incidents, or the nature of the issue.
Website platforms and plugins change over time. Plymouth Digital Services may apply updates, adjust configuration, or recommend changes to keep the site stable and secure. Where a change affects features or design, Plymouth Digital Services will aim to discuss options first.
Backups And Data Responsibility
Plymouth Digital Services may run backups as part of managed hosting. Backups reduce risk, but they do not guarantee recovery in every scenario, especially where data is corrupted before backup, overwritten, or removed by third-party services.
The customer should keep copies of any irreplaceable business data, original images, documents, and content. Plymouth Digital Services is not responsible for losses caused by the customer deleting data, failing to supply correct files, or failing to keep local copies.
Acceptable Use
The customer must not use hosting or website services for illegal content, infringement, harassment, malware, unauthorised access, spam, or activities that risk service stability. The customer must also follow any upstream provider rules that apply to hosting and email.
Plymouth Digital Services may remove content, block access, or suspend services if acceptable use rules are breached. Plymouth Digital Services will act quickly where risk is high, and will aim to explain actions once the immediate risk is controlled.
Liability And Limits
Plymouth Digital Services provides services with reasonable care and skill. However, Plymouth Digital Services does not guarantee specific rankings, revenue, conversion rates, sales, or business outcomes, because those depend on many factors outside Plymouth Digital Services control.
To the maximum extent allowed by law, Plymouth Digital Services is not liable for indirect loss, loss of profit, loss of data, loss of goodwill, or business interruption. Where liability cannot be excluded under UK law, liability is limited to the total fees paid by the customer for the affected service over the previous 12 months.
Cancellation And Termination
The customer can cancel services by giving notice through the published contact route. Plymouth Digital Services will confirm the cancellation date and what will happen to hosting, email, and domain renewals.
If services end, the customer is responsible for moving the website, content, and email to a new provider before the end date. Plymouth Digital Services may remove hosted data after the end date and is not responsible for losses caused by late transfers or incomplete migrations.
Complaints And Disputes
If something goes wrong, the customer should contact Plymouth Digital Services with clear details, screenshots where useful, and the preferred outcome. Plymouth Digital Services will respond in a reasonable time and aim to resolve issues promptly.
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
